1. Acceptance of Terms

By accessing or using Foxora ("Foxora", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not access or use the Service.

These Terms apply to all visitors, users, account holders, and customers who access or use Foxora.

2. Description of the Service

Foxora is an online creative platform that provides browser-based design and image editing tools. The Service may include features such as design editing, image editing, background removal, collage creation, templates, creative assets, and export tools.

Some features may be available without an account, while other features may require an account. Certain features, assets, templates, or other resources may be available only to users with an active paid subscription.

Foxora may add, modify, improve, or discontinue features from time to time as the Service develops.

3. Accounts and Registration

You may be required to create an account to access certain features of Foxora. You agree to provide accurate, complete, and up-to-date information when creating and maintaining your account.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account.

You must not create an account using false information, impersonate another person or organization, or create accounts for fraudulent or abusive purposes.

If you believe that your account has been accessed without your authorization, you should contact Foxora as soon as reasonably possible.

4. User Content

You retain ownership of the images, designs, text, and other content that you upload to or create using Foxora ("User Content"), except for materials that belong to third parties.

Foxora does not claim ownership of your User Content. However, when you upload or store User Content through the Service, you grant Foxora a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display that content only as reasonably necessary to operate, maintain, secure, and provide the Service to you.

This license does not give Foxora the right to sell your User Content or use it for unrelated commercial purposes without your permission, except where otherwise required by law.

You are solely responsible for the User Content you upload, create, store, or share through the Service.

5. User Content and Third-Party Rights

You must have the necessary rights, permissions, or licenses to use any content that you upload to Foxora. This includes images, photographs, logos, trademarks, fonts, text, graphics, and other materials that may belong to another person or organization.

You agree not to use Foxora to create, upload, store, or distribute content that infringes another person's intellectual property, privacy, publicity, or other legal rights.

Foxora is not responsible for determining whether User Content is properly licensed or authorized for use.

6. Acceptable Use and Prohibited Content

You agree to use Foxora only for lawful, legitimate, and appropriate purposes. You must not use Foxora to create, upload, store, process, publish, distribute, or share content or engage in activity that:

• violates any applicable law, regulation, or legal requirement;
• infringes copyrights, trademarks, patents, trade secrets, or other intellectual property rights;
• violates another person's privacy, publicity, image, or other legal rights;
• contains sexually explicit, pornographic, or NSFW content, including explicit sexual imagery or content created primarily for sexual gratification;
• depicts, promotes, facilitates, or exploits sexual abuse, sexual exploitation, or non-consensual sexual activity;
• depicts or sexualizes minors, or contains any sexual content involving a person who is or appears to be under the age of 18;
• is fraudulent, deceptive, threatening, harassing, hateful, or unlawfully harmful;
• promotes or facilitates violence, terrorism, exploitation, or other serious criminal activity;
• contains malware, malicious code, viruses, or other harmful software;
• attempts to bypass, disable, or circumvent account, subscription, payment, security, or access restrictions;
• attempts to interfere with, disrupt, damage, or compromise the security, performance, or availability of Foxora;
• uses Foxora to impersonate another person, organization, or entity, or to engage in fraud or deceptive practices; or
• otherwise abuses the Service or uses it in a manner that creates legal, security, operational, or safety risks to Foxora, its users, or third parties.

For clarity, Foxora strictly prohibits pornography, sexually explicit content, and other NSFW content in designs or uploaded images. This prohibition applies regardless of whether the content is created, uploaded, edited, stored, or shared using the Service.

Foxora also strictly prohibits any sexual content involving minors, including content that depicts, promotes, or sexualizes persons who are or appear to be under 18 years of age.

We may remove or restrict access to content that we reasonably believe violates these Terms or applicable law. We may also suspend or terminate accounts that violate these Terms, without prior notice where immediate action is reasonably necessary to address legal, safety, security, fraud, or other serious risks.

We may cooperate with law enforcement authorities or other appropriate parties where required by law or where reasonably necessary to address serious violations, security incidents, fraud, exploitation, or other unlawful activity.

7. Free and Premium Features

Foxora may provide both free and paid features, assets, templates, tools, or other creative resources.

Free features may be available without payment, subject to applicable account requirements and usage limitations.

Premium features and resources may require an active paid subscription.

We may change, add, remove, or update features, assets, templates, or other resources from time to time. Such changes may be made to improve the Service, correct technical issues, update third-party resources, or modify our product offerings.

8. Subscriptions and Payments

Foxora may offer paid subscription plans. The current subscription price and included features are displayed on the Foxora Pricing page before purchase.

Foxora Pro is offered as a monthly subscription at the price displayed on the Pricing page at the time of purchase. Unless otherwise stated during checkout, the subscription automatically renews for successive monthly billing periods until cancelled.

By purchasing a subscription, you authorize Foxora and its payment processing provider to charge the applicable subscription fee using the payment method provided during checkout.

Subscription charges are generally billed in advance at the beginning of each billing period.

If a payment fails, expires, is declined, or cannot otherwise be processed, Foxora may suspend or restrict access to paid features until a valid payment is received.

9. Subscription Cancellation

You may cancel your Pro subscription according to the cancellation process made available through Foxora or the applicable payment provider.

Cancellation generally prevents future subscription renewals. Unless otherwise stated at the time of cancellation, you may continue to use the paid features included in your subscription until the end of the current paid billing period.

Cancelling a subscription does not automatically refund amounts that have already been charged, except where a refund is required by applicable law or expressly provided under our Refund Policy.

10. Refunds

Refund requests are handled according to the Foxora Refund Policy, which is incorporated into these Terms by reference.

Unless otherwise required by applicable law or expressly stated in the Refund Policy, subscription payments are generally non-refundable once the applicable billing period has started.

Nothing in these Terms limits any mandatory consumer rights or refund rights that cannot legally be excluded or waived.

11. Price Changes

Foxora may change subscription prices or introduce new pricing plans from time to time.

If the price of an existing subscription changes, we will provide reasonable notice before the new price applies to a future billing period, where required by applicable law.

Any price change will not retroactively change a payment that has already been completed.

12. Payment Processing

Payments may be processed by third-party payment providers or payment processing services used by Foxora.

Payment information may be collected and processed by the applicable payment provider in accordance with its own terms and privacy policy.

Foxora does not intentionally store complete payment card numbers or security codes on its own servers when payment processing is handled by a third-party payment provider.

13. Intellectual Property

Foxora and its original software, interface, branding, logos, trademarks, website design, documentation, and other proprietary materials are owned by or licensed to Foxora and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or otherwise exploit the Foxora Service or its proprietary materials without prior written permission.

14. Third-Party Assets and Resources

Foxora may provide access to third-party or licensed creative resources, including images, graphics, fonts, templates, icons, or other assets.

Your use of such resources may be subject to additional license terms or restrictions.

You are responsible for complying with any applicable license terms associated with third-party materials.

Foxora does not guarantee that every third-party resource will remain available indefinitely.

15. Service Availability

We aim to keep Foxora available and reliable, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

The Service may occasionally be unavailable due to maintenance, updates, technical problems, third-party services, network failures, security incidents, or circumstances beyond our reasonable control.

16. Data and User Designs

You are responsible for keeping copies of important designs, images, and other User Content that you do not want to lose.

Although we take reasonable steps to operate the Service reliably, we cannot guarantee that User Content will never be lost, damaged, corrupted, or unavailable.

You should maintain appropriate backups of important projects and exported files.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Foxora is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.

We do not guarantee that the Service will meet your specific requirements or that it will always operate without interruption, delays, defects, or errors.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Foxora and its operators, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Service.

Where liability cannot be excluded under applicable law, our liability will be limited to the maximum extent permitted by applicable law.

19. Account Suspension and Termination

You may stop using Foxora at any time.

We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, create a security risk, engage in fraudulent activity, or where reasonably necessary to protect Foxora, our users, or third parties.

Where reasonably possible, we may provide notice before taking action. However, we may take immediate action when necessary to address security, legal, payment, fraud, or other serious risks.

Termination or suspension does not automatically entitle you to a refund unless required by applicable law or provided under our Refund Policy.

20. Changes to the Service or These Terms

We may modify, update, suspend, or discontinue any part of the Service from time to time.

We may also update these Terms when reasonably necessary. When changes are made, we will update the effective date shown on this page.

Your continued use of Foxora after the updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with applicable laws, without limiting any rights or protections that cannot be waived under applicable law.
